Chile's Ley N° 21.383, passed by the Congreso Nacional de Chile and published in the Diario Oficial on October 25, 2021, is a single-article constitutional reform amending Article 19 No. 1 of the country's Constitution, establishing at the constitutional level that scientific and technological development must serve people.
The amended provision states that scientific and technological development shall be carried out with respect for life and for physical and mental integrity, and that the law shall regulate the requirements, conditions and restrictions for its use on people, specially safeguarding brain activity and the information derived from it. With this reform, Chile became the first country in the world to grant express constitutional protection to brain activity and neurorights.
