House Bill 24-1058, Protect Privacy of Biological Data, passed by the Colorado General Assembly, was signed by the Governor on April 17, 2024 and took effect on August 7, 2024. The act amends the Colorado Privacy Act to expand the definition of sensitive data to include biological data.
Under the act, biological data means data generated by the technological processing, measurement, or analysis of an individual's biological, genetic, biochemical, physiological, or neural properties that can be used for identification purposes; neural data is defined as information generated by the measurement of the activity of an individual's central or peripheral nervous system that can be processed by or with the assistance of a device. It is the first US state law to bring neural data under a comprehensive privacy statute. Prime sponsors were Representatives Cathy Kipp and Matt Soper and Senators Mark Baisley and Kevin Priola.
